IN CONSIDERATION of being permitted access to transportation on the motor vehicle transportation provided by Alboumeh Party Bus, LLC (the “Bus”) or being permitted to enter or board the Bus for any purpose, the undersigned individual, for himself/herself, his/her personal representatives, heirs, and next of kin:

1. Acknowledges and agrees that (A) riding on the Bus is a potentially dangerous activity; (B) the Bus may need to make sudden stops without warning; (C) riding without a seat belt, standing, and walking on the Bus is an potentially dangerous activity; (D) the floor and steps of the Bus may be slippery, especially if it has been raining or snowing; and (E) consumption of alcohol or other intoxicating substances which impair cognitive and motor functions will make the conditions of the Bus more dangerous for all passengers aboard, including myself.

2. Acknowledges, agrees, and represents that (A) he/she has, or will immediately upon entering or boarding the Bus, and will continuously thereafter, inspect the area of the Bus which he/she enters; and (B) he/she further agrees and warrants that, if he/she is on the Bus and feels anything to be unsafe at any time, he/she will immediately advise the driver of the Bus of such unsafe or hazardous condition(s) and will refuse to participate further in any activity on the Bus which would continue or further such unsafe or hazardous condition(s); and (C) if necessary, he/she will exit the Bus as soon as it is safe to do so. 

3. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Alboumeh Party Bus, LLC, its affiliates, predecessors, successors, assigns, parents, subsidiaries, members, managers, officers, agents, insurers, attorneys, fiduciaries, advisors, employees, and representatives FROM ALL LIABILITY TO THE UNDERSIGNED, his/her personal representatives, assigns, heirs, and next of kin (collectively, the “Releasees”) FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

4. HEREBY AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS the Releasees FROM ANY LOSS, LIABILITY, DAMAGE, or COST they may incur arising out of or related to the UNDERSIGNED’S TRANSPORTATION ON THE BUS, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

5. HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE arising out of or related to TRANSPORTATION ON THE BUS, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

6. HEREBY acknowledges that TRANSPORTATION ON THE BUS IS POTENTIALLY DANGEROUS and involves the risk of serious injury and/or death and/or property damage.  THE UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.

7. HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement extends to all acts of negligence by the Releasees, INCLUDING NEGLIGENT RESCUE OPERATIONS, and is intended to be as broad and inclusive as is permitted by the laws of the Province or State in which any such incident(s) occur(s), and that, if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

8. Persons under the age of 21 years shall not be allowed to consume alcohol on the Bus.  If anyone appears intoxicated or if alcohol is consumed by someone under the age of 21 on the Bus, then Alboumeh Party Bus, LLC shall have the right, but not the obligation, to remove any such person(s) from the Bus without a refund of payment.
